Membership Number
• The membership number is unique to each of your accounts. Kindly quote the membership number for all your transactions and correspondences with Manipal Cure and Care.
Membership Card
• The Membership card takes 24 hours to get activated
Please carry your card during all your future visits to Manipal Cure and Care center and present it while billing.
• At the time of billing, please notify the attending personnel about your card to avail discounts, and to gain bonus points on the purchases (products and / or services) made.
• In case you forget to carry your loyalty card during your visit, kindly notify the attending personnel before billing. Give your membership number or answer questions based on the details provided by you in your Customer Application Form to avail privileges and credit points. Please note that this procedure is part of our safety protocol that has been devised to safeguard your interests and to prevent possible misuse of your card.
• The card can be used at any authorized Manipal Cure and Care center across India.
• No cash refund will be entertained for purchases made.
• Member’s signature is subject to verification at the time of purchase or redemption.
• Membership validity is for the period of 1 year from the date of issue.
• The card is not transferable
Wellness Points
• Allotment of points will be solely at the discretion of Manipal Cure and Care.
• The wellness club Card can be received:
- On payment of Rs. 500/- against the enrollment form.
- On purchases worth Rs. 500 or more during a calendar month.
• Points are allocated on a daily basis.
For purchases done today, points are allocated within the next 24 hours, and hence, can be redeemed only the next day.
• You can earn points only when payment is made by Debit Card, Credit Card or Cash or Sodexho gift vouchers.
• No points are earned where payment is made through:
- Gift Vouchers
- Accor Ticket or any other Gift Vouchers/ Certificates
- Credit Note
Redemption of Points
• Points can be redeemed at any authorized Manipal Cure and Care center across India.
• Loyalty points can be redeemed once there is a minimum balance of 10 points.
• Points earned on the card can be redeemed partially or wholly against selected products and / or services.
• For redemption of points, you have to produce the Wellness Club card issued to you; else the points cannot be redeemed.
• Please note that for purchases made on a particular day, points earned on that transaction cannot be redeemed instantly but on the next consecutive day since points are allocated on a daily basis.
• Redemption of points will be solely at the discretion of Manipal Cure and Care
• Points once redeemed cannot be re-credited
Card Renewal
A month before the renewal date, intimation will be sent to you requesting you to renew your card.
• The silver and the Gold card will be renewed after 1 year by paying Rs. 500 or billing Rs. 500/-.
• If the validity of the card has expired, you can go to the Manipal Cure and Care center with your old card, and apply for the new card.
Cancellation
A Member ceases to be a Manipal Cure and Care wellness club member in the following ways:
• Automated Exit: Where the member does not use his/her card within one year of activation of card.
• Voluntary Exit: Where the member initiates the process of terminating his/her membership
• Involuntary Exit: Where the member has misused the card etc.
Card Upgrade
• Silver card members will be eligible for a Gold card if cumulative bill value crosses Rs.15, 000/- within 12 months after activation of Silver card.
• Gold card members can upgrade to platinum card if cumulative bill value crosses Rs2 Lakh in 12 months
Data Updation
The data updation refers to the changes made by the member for any of the following details:
• Name change
• Card name change
• Date of birth correction
• Address change
• Change in Telephone Numbers/Mobile Number/Fax Numbers
• Pin code update
• Email ID
• Update marital status
The member can fill up a member updation form at the center to update his/her information
Card Lost//Stolen
• In case the card is either lost, misplaced by you or is stolen, immediately notify the issuing center of Manipal Cure and Care in writing to prevent any kind of misuse.
• Fill in the Card Lost form at the center.
• Upon cross-checking and confirmation, a new card will be issued within a specified time limit at an issuance cost of Rs.100/-.
• Manipal Cure and Care will not be responsible for the points if the card is stolen.
Duplicate Card Issue Process
• Duplicate cards will be issued to you upon request to get the new card.
• After the registration of the duplicate card, the original card will be cancelled.
• Fee for duplicate card Rs. 100/-
Definition
In this agreement, the following words shall have the respective meanings set out hereunder unless the context otherwise requires:
(a) “Card” means any card issued by Manipal Cure and Care for use to effect Card Privileges and includes any card issued in replacement or renewal thereof.
(b) “Cardholder” where used in relation to any Card means the person to whom the Card is issued.
(c) “Card Account” in relation to any Card means the account designated and maintained by Manipal Cure and Care in relation to that Card provided that where only one account is designated and maintained by Manipal Cure and Care for all the Cards issued to the Cardholder any reference to the Card Account shall mean that account.
(d) “Card Privilege” means the benefits entitled to the Cardholder under the Agreement of the application within the limits of the terms and conditions agreement.
(e) “Card Transaction” means the recorded usage of the Card for privileges entitled under the Agreement.
(f) “MCC” means Manipal Cure and Care.
(g) The term family in relation to coverage under the family scheme means & includes the spouse & dependant children below the age of 21 years, brothers & sisters, father- in- law, mother- in -law, who the primary card holder has enrolled under his or her membership. Child up to 12 years can avail card benefit on their father/mother’s Manipal Cure and Cure wellness card hence the child is not eligible for the card of his/her own
1. ELIGIBILITY
1.1 A customer can become a silver card member by filling the customer enrollment form online, in person, make a payment of Rs. 500/- or purchase more than Rs. 500/-during a calendar month at any Manipal Cure and Care center across India.
2. FACILITIES AVAILABLE WITH THE CARD
2.1 The Card shall be used only for effecting Card Privileges subject to these terms and conditions and to compliance with such requirements limitations and procedures as may be imposed by Manipal Cure and Care and where applicable.
3. LOSS OF CARD
3.1 Immediately upon learning that the Card is lost or stolen, the Cardholder shall report and give Manipal Cure and Care written confirmation of the loss or theft. The Cardholder shall at the request of Manipal Cure and Care furnish Manipal Cure and Care with a statutory declaration in such form as Manipal Cure and Care may require and a police report and any other information as Manipal Cure and Care may require. If the lost or stolen card is found or recovered, the Cardholder shall not make use of the Card but shall immediately cut it in halves and return to Manipal Cure and Care.
3.2 Replacement of lost, stolen or destroyed card will done at a charge of Rs.100/-.
4. TERMINATION OF USE OF CARD
4.1 The use of any or all Cards may be terminated by Manipal Cure and Care at any time without prior notice and without assigning any reason for such termination. The use of any or all Cards may be terminated by the Cardholder by written notice and returning to Manipal Cure and Care the Card cut in halves provided that such termination shall be effective only upon receipt of such Card by Manipal Cure and Care.
5. USAGE OF THE CARD
Only the primary cardholder is authorized to use the scheme to access the services & products at Manipal Cure and Care centers. In the event of misuse of the card, the membership to the scheme is liable to be cancelled and no refund will be made. The membership to the scheme is non transferable and no responsibility is owned to non members. The present offer or an offer of Manipal Cure and Care cannot be clubbed or used in conjunction with other offers.
6. EXTENSION OF PRIVILEGES
6.1 Manipal Cure and Care reserve all rights to reject any extension of the privileges entitled under the Card without arising any reasons for so doing or without any prior notification.
7. MEMBERSHIP UPGRADATION
7.1 Silver card members will be eligible for a Gold card if cumulative bill value crosses
Rs.15, 000/- within 12 months after activation of Silver card.
7.2Gold card members can also upgrade to platinum card if cumulative bill value crosses Rs2 Lakh in 12 months
7.3 Once you are eligible, Manipal Cure and Care sends you the upgraded card on the billing address provided by the member at the time of enrollment with the card.
8. EXCLUSIONS AND EXCEPTIONS
8.1 Manipal Cure and Care shall not be responsible or liable to any and all Cardholders for any loss or damage incurred or suffered as a consequence of:
8.2 Any malfunction, defect or error in any machine or system of authorization whether belonging to or operated by Manipal Cure and Care or otherwise; or
8.3 Any delay or inability of Manipal Cure and Care to perform any of its obligations pursuant to this Agreement because of any mechanical, data processing or telecommunication failure, Act of God, civil disturbance or any event outside Manipal Cure and Cure control or as a consequence of any fraud or forgery; or
8.4 Any damage to or loss of or inability to retrieve any data or inform that may be stored in any Card or any microchip circuit or device in any Card howsoever caused.
8.5 Manipal Cure and Care shall not be responsible for the delivery quality or performance of any goods and services paid for through the use of the Card including goods or services made available or introduced to any Cardholder by Manipal Cure and Care.
9. CONCLUSIVENESS OF DOCUMENTS AND CERTIFICATES
9.1 Manipal Cure and Care shall be entitled to rely upon and to treat any document relating to any Card Transaction with the signature of any Cardholders as conclusive evidence of the fact that the Card Transaction as therein stated or recorded was authorized and properly made or effected by the Cardholder.
10. NON-REFUNDABLE REGISTRATION FEES
10.1 For termination of the card by either party (i.e.) the Cardholder(s) or Issuer, no refund will be made to the membership fees.
11. VALIDITY
11.1 The Card is valid for one year from the date of issue.
11.2 Renewal upon expiry will be subject to the approval of the Card Issuer.
12. AMENDMENTS
12.1 Manipal Cure and Care may at any time amend any of these terms and conditions without giving notice to the Cardholder in the manner prescribed herein of such amendment(s).
Such amendment(s) shall take effect on the date specified in such notice. If the Cardholder continues to retain or use any Card after the specified date, then the Cardholder is deemed to have accepted such amendment(s).
13. DISCLAIMER OF WARRANITES AND LIMITATION OF LIABILITY
13.1 The member acknowledges that the products and services are provided on an ‘as is’ basis no representations or warranties whatsoever, express or implied, including but not limited to representations or warranties as to description, quality, productiveness, accuracy, nature, correctness or fitness or service for a particular purpose are made.
13.2 The member assumes all risk for selection and use of the service & products. The member shall be solely responsible for any error, misstatements, forgery, negligence, delays, inaccuracies, acts or omissions in connection with the delivery of services and products.
13.3 On behalf of the member and any person who uses the services or products under the card, the member releases, acquits, and discharge Manipal Cure and Care from any and all liabilities, claims, demands, actions and causes of action that the member, his family and/or their legal representatives may have, by reason of any damage (whether or not pecuniary) or injury (whether or not personal) sustained as a result of or during the use of any and all services and/or products available under or through the card.
13.4 The member agrees to indemnify and hold Manipal Cure and Care from any claims, lawsuits, proceedings, costs, attorney fees, damages or other losses arising out of or relating to the members use or nonuse of the services, in all cases including but not limited to losses for tort, personal injury, medical malpractice or product liability without limiting the generality of the foregoing. In no event shall Manipal Cure and Cure be liable for any special, incidental, consequential, or indirect damages, including damages for loss of profits, loss of business, or down time, even if they have been advised of the possibility of such damages.
13.5 In any event, the total liability (if any) on the part of Manipal Cure and Care whether arising under contract or otherwise, is limited to the fees received from or on behalf of the concerned member under this program.
14. DISCLOSURE OF INFORMATION
14.1 Manipal Cure and Care may disclose any information relating to any Cardholder or Card Transaction to any person or entity if Manipal Cure and Care considers it in its interest to do so.
15 MISCELLANEOUS
15.1 Any request of or instruction to Manipal Cure and Care shall be in writing and shall be signed by the Cardholder provided nevertheless the Manipal Cure and Care may but shall not be obliged to accept and act on any instruction or request by telex facsimile transmission or through the telephone which is believed by the officer or employee of Manipal Cure and Care attending to such instruction or request may not have been given or made or authorized by such Cardholder and not withstanding any fraud that may exist in relation thereto and Manipal Cure and Care shall not be liable for any loss or damage suffered as a consequence of its acting on or acceding to any instruction or request.
15.2 All Cardholders submit themselves to the non-exclusive jurisdiction of the Karnataka High Court.
15.3 Any forbearance or failure or delay by Manipal Cure and Care in exercising any rights, power or remedy shall not be deemed to be a waiver or a partial waiver of such right, power or remedy unless such rights, powers or remedies are specifically waived by Manipal Cure and Care in writing. |
